Compensation claims for damages, injury or loss

If you suffer an injury or damage to your personal property because of Council's negligence you may wish to seek compensation. This can include injury from tripping on pavement, damage caused by driving over a pothole, or Council mowing damage.

For us to consider your claim, you must provide evidence substantiating your loss. You must also prove we have breached a duty to prevent harm, making us liable under the Civil Liability Act 2003.

While we may own or maintain land or assets where an incident has occurred, it is not an automatic admission of liability.


Report the hazard

If the hazard that may have caused or contributed to your incident still poses a risk and requires action, phone 07 5424 4000 or lodge a Customer Service Request.


Claiming through your insurance

You can lodge a claim with your insurance company and if they consider us liable, they may seek compensation from us.


Before making a claim

Before making a claim, there are documents you may need to provide, such as:

  • photos of injuries sustained 
  • photos of the location, damage or injuries
  • substantiating medical report
  • written authority
  • sketch or map of the location
  • invoices
  • receipts
  • repair quotes

It is your responsibility to provide evidence to substantiate your claim.

Responsible entity

We cannot assess a claim where we are not the responsible entity. If we identify your claim relates to a Council contractor, we will refer your claim to them.

When you submit a completed claim form, you consent to us disclosing the details of your claim to the contractor. This includes supplied files and personal information.

We will let you know if this happens. We will provide you with the contractor’s contact details, and they will contact you about your claim. 

If your claim relates to another entity, such as Urban Utilities, Energex, Seqwater or Queensland Transport and Main Roads, we will advise you in writing to contact them.


Legal advice

We cannot provide legal advice or assist in the completion of the claims form on your behalf. We encourage you to seek independent legal advice for your unique situation. 


Damage from storm or weather events

We may not be liable for damage to private property or personal injury from a storm or weather event. These incidents are ‘acts of nature’.
